While there is no guarantee the judge will order mediation, we are available to assist if the case is referred.
Mediation and alternative dispute resolution are strongly supported under Texas law, including Texas Civil Practice & Remedies Code Chapter 154, which states that it is the policy of the state to encourage the peaceable resolution of disputes and the early settlement of pending litigation.
The statute authorizes courts to refer cases to mediation (§154.021), defines the mediator’s role as an impartial facilitator (§154.023), sets mediator qualification standards (§154.052), protects the confidentiality of mediation communications (§154.053), provides qualified immunity for mediators acting within their role (§154.055), and confirms that written mediated settlement agreements are enforceable (§154.071).
In family law matters, Texas Family Code §153.0071 provides that properly executed mediated settlement agreements are binding and not subject to revocation.
Texas Rule of Civil Procedure 166 authorizes courts to promote settlement and refer cases to mediation during pretrial proceedings.
Mediators serving in court programs and professional settings are also commonly required to comply with the Ethical Guidelines for Mediators published by the ADR Section of the State Bar of Texas, which establish standards for neutrality, confidentiality, informed consent, and avoidance of conflicts of interest.
